These Terms of Use govern your use of cactussamara.com (the “website”), operated by El Cactus Services (“Cactus”, “we”, “us”), 100 meters west of the National Bank, C. Diego, Sámara, Guanacaste, 50205, Costa Rica. By using the website or sending us a booking request, you accept these terms.
Purpose of the website
The website presents our ATV tours and our ATV, scooter and mountain bike rentals in Sámara, and lets you send us a booking request. We do our best to keep the information accurate and up to date, but descriptions, photos, itineraries and prices are provided for information and may change.
Booking requests
- Sending the booking form (or a message on WhatsApp or by email) is a request, not a confirmed booking. Your reservation is confirmed only once our team has confirmed it to you by WhatsApp, email or phone.
- All bookings are subject to availability of vehicles, guides and weather conditions.
- Prices shown on the website are in US dollars and are indicative. The final price is the one confirmed by our team before your activity.
- Payment is made in cash at our agency when you pick up your vehicle or before your tour starts. No payment is taken on the website.
- You must provide accurate contact details so that we can confirm or discuss your request.
Rental and tour conditions
The conditions of each rental or tour — including required documents (such as a valid driver’s license), minimum age, security deposit, insurance, safety equipment and responsibility for damage — are set out in the rental or participation agreement you sign at our agency before your activity. That agreement prevails over the general information on this website. Please ask us before booking if you have any question about these conditions.
Riding an ATV, scooter or mountain bike involves risks. Riders must follow our team’s and guides’ safety instructions, wear the protective equipment provided, respect Costa Rican traffic laws and never ride under the influence of alcohol or drugs. We may refuse or end a rental or tour if these rules are not respected or if safety is at risk.
Changes and cancellations
If you need to change or cancel a booking, please tell us as soon as possible by WhatsApp or email. We may have to change or cancel a tour or rental for safety reasons (for example weather, road conditions or vehicle availability); in that case we will contact you to offer another date or cancel your booking.
Use of the website
You agree to use the website lawfully and not to:
- send false, abusive or automated (spam) requests;
- attempt to access, disrupt or damage the website, its servers or its data;
- copy or reuse the website’s content in breach of the section below.
Intellectual property
The Cactus name and logos, texts, photos, videos, illustrations and design of the website belong to El Cactus Services or to their respective owners and are protected by intellectual property laws. You may not reproduce or use them without our prior written permission, except to share a link to the website.
External links
The website contains links to and content from third-party services (Google Maps, Google reviews, WhatsApp, Instagram, Facebook). We are not responsible for their content or their practices; their own terms apply.
Liability
We cannot guarantee that the website will always be available or free of errors. To the extent permitted by Costa Rican law, Cactus is not liable for indirect damage resulting from the use of the website or from the temporary unavailability of information. Nothing in these terms limits the rights you have as a consumer under Costa Rica’s Law No. 7472 on the Promotion of Competition and Effective Consumer Protection or any other mandatory law.

The personal data you send us is processed as described in our Privacy Policy.
Governing law
These terms are governed by the laws of the Republic of Costa Rica. In case of a dispute, we encourage you to contact us first so that we can look for an amicable solution. Failing that, the competent courts of Costa Rica will have jurisdiction, without prejudice to any mandatory consumer protection rules that apply to you.
